A Dalton case could be the first test nationwide of a new federal law protecting renters during foreclosure.



“It’s the first test I know of,” said Bill Bell Jr., the attorney for First Georgia Banking Co. 

The bank foreclosed on two homes in Dalton owned by Paniagua Construction in June, and sent letters to the occupants saying they must leave by Sept. 25. 

Attorneys for both sides say one tenant has already vacated her home. But April Arrieta, who had a 30-year lease to buy from Paniagua, still wants to continue living in the house she has occupied since November 2008 and has continued to make her rent payments, according to her attorney, Cynthia Gibson, an attorney for Georgia Legal Services in Dalton.

“She’s trying to buy the home, trying to get financing to purchase the home,” said Gibson. Arrieta was out of town at press time.
